What is the purpose of a Homeowners Association?

The purpose of the HOA can be found on page 1 of the Declaration, item D, of the Recitals:  “to establish certain mutually beneficial common elements, covenants, restrictions, and equal obligation for the cooperative development, improvement, use, operation, maintenance, repair, and enjoyment of such planned community under a general plan for the purpose of enhancing and perfecting the value, desirability, and attractiveness of such a planned community.”

Meaning the HOA (Association) was made to establish equal obligation and cooperation among the Members to uphold a set of governing documents; and contribute to the development, improvement, use, operation, maintenance, repair, and enjoyment of the Whole community not just the common elements. The purpose of the obligation and cooperation, resulting in mutual benefit, is the enhancing and perfecting the value, desirability, and attractiveness of the community.

Which is why we need homeowner input and involvement. 

  • Following the governing documents establishes equal obligation.

    • We all need to follow them equally - no variances (no special treatment) if the standards set in place in the governing documents no longer serve the purpose they were intended for we need to amend the governing documents to maintain the equality, but until then all violations should be enforced for equality.

    • Enforcement following the governing documents provides equality and fairness with notice and the right to be heard (tribunal hearing).

    • Equal financial obligation in Assessments (declaration section 6)

  • Following the governing documents in regards to “Maintenance” (declaration section 5), and “Use Restrictions” (Declaration section 8) enhances the attractiveness of the community (but not necessarily personal convenience; that was not a consideration for the purpose of the community).

  • Following the governing documents with concerns to the Design Review Committee (Declaration section 7) is for the same purpose of the HOA with emphasis on enhancing and perfecting value. We are working on making this a more streamline process and a process which clearly defines the reason for rejection explaining why your improvements are not enhancing the value and attractiveness of your Lot, so this process is also a value to the Members and the community. 

  • Following the governing documents in relation to the Rules and Regulations provides equality in enjoyment and use of a Member’s own Lot and also that of the Common Elements.

We would love to implement ideas/events/activities that would positively highlight our neighborhood in the community, but really need more manpower to accomplish all our goals. So if you are interested in volunteering in any scope please reach out!!

  • Examples:

    • Do you like sports? Do you want to play on a neighborhood team? Or would you just be interested in coming to watch and cheering for the “home team” as a free family activity? 

    • Do you love to decorate for the holidays and spread that happy feeling it gives you? Would you be willing to organize/promote neighborhood decorating participation to promote within our larger community of Fort Collins Maple Hill as the “it” place to come look at holiday lights, patriotic displays, or chilling Halloween decorations?
